Prop Trust Verified® is born of three decades of experience as a Judicial Perito in real conflicts: where a bad tile generated a structural failure, where a clause hidden in a maritime title annulled an investment of millions, and where the absence of a physical inspection cost more than the asset itself.

This document is not a commercial proposal. It’s a working protocol. A standard we invite the industry to adhere to.

Chapter I: The Verification Triangle

1.1 Physical verification

It’s not enough with a drone photo. We require human presence, calibrated instrumentation and validated methodologies in courts (ISO 17020).

• Structural inspection with ultrasounds and thermogram
• Evaluation according to UNE 41100 (edifices) and IMO A.1023(26) (nival)
• Report signed by collegiate judicial expert

1.2 Legal verification

The record title is only the beginning. We analyze:

• Procurement and unregistered servitudes
• zoning and licensing conflicts
• Accident history (IMO GISIS) for naval assets
• Validation with 12 public and private databases

1.3 Digital verification

We create a digital twin (BIM + GIS) that integrates historical data, maintenance and sensors in real time.

Chapter II: Prop Trust Verified® Methodology

Phase 1: Pre-Verification (5 days)

Collection of primary documentation and definition of the scope of inspection.

Phase 2: On-Site Inspection (2-3 days)

Multidisciplinary team (civil expert, naval and architect) on site. Includes topographic measurement, mapping review and interviews.

Phase 3: Legal Audit

Analysis of 7 layers of ownership and legal risk. Report with probability matrix (Alta/Media/Baja).

Phase 4: Digital Twin & Data Validation

Generation of virtual twin and load on secure platform. Access to the investor with interactive dashboard.

Phase 5: Certification

Emission of certificate Prop Trust Verified®with digital signature of the expert and seal of Aurema Group LLC. Validity: 12 months.

Chapter III: Cases of Implementation

Historical Building (Valencia, 2024)

Challenge: Clean title, but unregistered servitude and moisture damage.

Solution: Termography revealed leaks; municipal archive discovered a sentence of 1952.

Outcome: Price reduction in 22% and extended warranty clause.

Pesquero Ship (2023)

Challenge: Complete documentation, but hidden repairs after breakdown.

Solution: Ultrasounds revealed defective welding; IMO GISIS showed 3 unreported incidents.

Outcome: Operation suspended. Saving: €3.2M.

Solar Plant (Extremadura, 2022)

Challenge: Permission in force, but conflict with POT not detected.

Solution: Georeference revealed overlap with hydrological protection zone.

Outcome: Renegotiation of the price and guarantee of regulatory compliance.

Chapter IV: Tokenization and Regulatory Compliance

MiCA (EU)

Regulation (EU) 2023/1114 requires:

  • Independent verification report (such as Prop Trust Verified®)
  • Segregation of assets in specific SPV
  • Governance for non-compliance events

Nuestros modelos no son estimaciones subjetivas. Son fórmulas validadas en sentencias judiciales y ajustadas a la realidad física y jurídica del activo.

B.1 Valor Actualizado (Vₐ)

Vₐ = Vₘ × (1 − Df) × (1 − Rj)

Donde:

  • Vₘ = Valor de mercado según tasación oficial
  • Df = Descuento por fallos estructurales (0.05 a 0.30)
  • Rj = Riesgo jurídico (0.02 a 0.25)

Ejemplo real (Edificio Valencia, 2024):
Vₘ = €4.2M → Df = 0.18 (grietas + humedad) → Rj = 0.12 (servidumbre no inscrita) → Vₐ = €3.28M

B.2 Vida Útil Restante (Tᵣ)

Modelo basado en deterioro acelerado (UNE 41100 + ISO 15927):

Tᵣ = T₀ × [1 − (C / Cₘ)ⁿ]

Donde:

  • T₀ = Vida útil nominal (ej. 60 años para hormigón)
  • C = Condición actual (medida por termografía/ultrasonidos)
  • Cₘ = Condición máxima admisible
  • n = Factor de aceleración (1.2 para humedad, 1.5 para corrosión)

Caso Buque “María Luisa”:
T₀ = 30 años → C/Cₘ = 0.78 → n = 1.5 → Tᵣ = 14.2 años (vs. 22 años declarados)

B.3 Coste de Reparación Esperado (CRE)

Basado en datos de 127 casos judiciales (2020–2025):

Anexo C: Protocolo Técnico de Inspección On-Site

Este protocolo debe ser seguido por todo equipo de inspección de Aurema Group. Cualquier desviación debe justificarse por escrito y firmarse por el Perito Responsable.

C.1 Pre-Inspección (Día -1)

  1. Revisión completa de documentación: títulos, planos, licencias, historial de mantenimiento.
  2. Definición del scope: zonas críticas (ej. cimentación, uniones estructurales, tanques).
  3. Calibración de equipos: ultrasonidos, termografía, nivel láser (certificado vigente).

El informe preliminar debe contener:

Anexo D: Resolución de Discrepancias Técnicas

Cuando dos peritos emiten conclusiones opuestas sobre un mismo activo, Aurema Group aplica el siguiente protocolo, validado en 14 arbitrajes técnicos (2021–2026).

D.1 Cláusula de Árbitro Técnico (Recomendada)

“En caso de discrepancia entre peritos, las partes designarán un Árbitro Técnico independiente, colegiado y con ≥15 años de experiencia en el ámbito relevante (edificación, naval o infraestructura). El árbitro dispondrá de 10 días hábiles para emitir su dictamen, vinculante para ambas partes.”

D.2 Perfiles Aceptados como Árbitros Técnicos

D.3 Protocolo de Arbitraje (5 Pasos)

  1. Selección: Las partes proponen 3 candidatos cada una. Se elige por consenso o sorteo.
  2. Acceso a información: El árbitro recibe toda documentación, incluyendo informes originales y raw data (fotos, lecturas de sensores).
  3. Inspección complementaria: El árbitro puede requerir nueva inspección en sitio (coste compartido 50/50).
  4. Dictamen: Debe incluir: metodología usada, fuentes de datos, fórmulas aplicadas y conclusión con margen de incertidumbre.
  5. Vinculación: El dictamen se adjunta al contrato y es ejecutable ante notario.

Ejemplo real (Arbitraje Madrid, 2025):
Dos peritos discreparon en la vida útil de un puente. El árbitro (Prof. Dr. L. Martínez, ETSI Caminos) aplicó el modelo Tᵣ y concluyó: “Vida útil restante: 18.3 años (IC 95%: 16.1–20.5)”. La sentencia del Juzgado de lo Mercantil nº 8 dio por válido el dictamen y resolvió la disputa en 7 días.
